A member of Iran's Supreme Council of Cyberspace has stated that Telegram must adhere to the laws of the Islamic Republic of Iran, similar to its compliance with regulations in France. Discussions between Iran's Ministry of ICT and Telegram began several weeks ago, based on a 32-article resolution approved by the Supreme Council of Cyberspace in January 2025.
Rasoul Jalili, a member of the council, told Fars News Agency: "On January, the Supreme Council of Cyberspace approved a 32-article resolution aimed at facilitating regulated access to foreign platforms. Recent actions regarding Telegram are part of implementing one of these provisions."
Key Provisions in Cyberspace Governance
Jalili emphasized the importance of implementing the resolution in its entirety. He stated that all stages of the 32 provisions must be executed with the quality and sequence as approved by the council. He noted that some provisions might be implemented concurrently by relevant authorities, including the Ministry of ICT, which he deemed acceptable.
The resolution outlines policies and strategic measures for regulated governance in cyberspace. It also includes initiatives to protect domestic platforms while ensuring foreign platforms operate under Iranian regulations.
Concerns Over Negotiations With Telegram
Jalili expressed concern about potential agreements with Telegram. He cautioned against mechanisms resembling snap-back provisions, which he believes could undermine Iran's fundamental rights in cyberspace governance.
He highlighted the importance of ensuring Telegram treats Iran with the same seriousness it applies to other countries, such as France. He pointed out that other nations demand compliance from Telegram on issues like combating terrorism, adhering to social norms, and taking responsibility for content.
Critical Requirements for Agreement
Jalili outlined key points for any agreement with Telegram. These include storing Iranian users' data within the country, appointing a legal representative to respond to judicial and law enforcement authorities, ensuring advertisements comply with Iranian laws, and monitoring financial transactions under Central Bank regulations. Additionally, taxes and value-added taxes should apply to purchases and sales made through Telegram. The platform must also be held accountable for issues related to smuggling or illegal activities.
He stressed the importance of clarity on dispute resolution mechanisms, enforcement guarantees, and adherence to Iranian laws in case of violations.
Risks of Inadequate Guarantees
Jalili warned against lifting restrictions on Telegram without enforceable guarantees. He said such actions could create challenges for governance, police responsibilities, judicial oversight, and user security. Reliable guarantees and sufficient transparency must be ensured during negotiations to protect national interests.
